Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") stipulate the conditions for using the services (hereinafter referred to as "the Service") provided on this website by NSI LLC (hereinafter referred to as "the Operator"). Users of the Service (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

These Terms shall apply to all relationships related to the use of the Service between Users and the Operator.

Article 2 (User Registration)

  1. To use the Service, a prospective registrant shall apply for user registration in the manner prescribed by the Operator after agreeing to these Terms, and the registration shall be completed when the Operator approves the application.
  2. The Operator may not approve the registration application if the applicant falls under any of the following circumstances, and shall not be obligated to disclose the reason:
    1. If false information was provided at the time of registration application.
    2. If the application is from a person who has previously violated these Terms.
    3. If the Operator determines that the registration is otherwise inappropriate.

Article 3 (Management of User ID and Password)

  1. Users shall manage their user IDs and passwords for the Service appropriately at their own responsibility.
  2. Users shall not transfer or lend their user IDs and passwords to third parties, or share them with third parties. The Operator shall regard any sign-in made with a combination of user ID and password that matches the registered information as use by the registered User.
  3. The Operator shall not be liable for any damage caused by the use of a User ID and password by a third party, except in cases of intentional misconduct or gross negligence by the Operator.

Article 4 (Intellectual Property Rights)

  1. Users shall only post and edit works such as texts and images for which they hold the necessary intellectual property rights, or for which they have obtained the necessary permissions from rights holders, when using the Service.
  2. The copyrights of content such as texts, images, and programs posted or edited by Users using the Service (hereinafter referred to as "User Content") shall remain with the respective User or rights holder.
  3. All rights (ownership, intellectual property rights, portrait rights, publicity rights, etc.) of the texts, images, programs, and other data that constitute the Service, except for those created by Users, belong to the Operator or third parties holding the respective rights.
  4. Users and third parties may not reproduce or redistribute User Content without the permission of the rights holder.
  5. Users grant the Operator permission to publish and distribute (including public transmission and making available for transmission) User Content on the website.

Article 5 (Prohibited Actions)

Users shall not engage in the following actions when using the Service:

  1. Actions that violate laws or public order and morals.
  2. Actions related to criminal activity.
  3. Actions that infringe intellectual property rights such as copyrights included in the Service.
  4. Actions that destroy or interfere with the functions of servers or networks of the Operator, other Users, or third parties.
  5. Actions that commercially utilize information obtained through the Service.
  6. Actions that may interfere with the operation of the Operator's services.
  7. Actions involving unauthorized access or attempts thereof.
  8. Actions involving collecting or accumulating personal information about other Users.
  9. Actions using the Service for fraudulent purposes.
  10. Actions repeatedly accessing the API server directly without using the Service's provided functions.
  11. Actions involving sharing of an account by multiple individuals, except as expressly permitted by the operator.
  12. Actions involving possession of multiple accounts by a single individual, except as expressly permitted by the operator.
  13. Actions that cause disadvantage, damage, or discomfort to other Users or third parties.
  14. Actions impersonating other Users.
  15. Actions involving advertising, soliciting, or conducting business activities not permitted by the Operator on the Service.
  16. Actions aimed at meeting or dating unfamiliar individuals of the opposite sex.
  17. Actions involving religious activities or solicitations to religious organizations.
  18. Actions providing benefits directly or indirectly to anti-social forces in connection with the Operator's services.
  19. Other actions that the Operator deems inappropriate.

Article 6 (Suspension of Service Provision)

  1. The Operator may suspend or interrupt the provision of all or part of the Service without prior notice to Users if it determines any of the following circumstances:
    1. When performing maintenance or updates of the computer system related to the Service.
    2. When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters.
    3. When computers or communication lines are stopped due to accidents.
    4. Other circumstances in which the Operator determines it is difficult to provide the Service.
  2. The Operator shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service provision.

Article 7 (Usage Restrictions and Deregistration)

  1. The Operator may restrict the use of all or part of the Service (including changes to user information such as usernames) or deregister a User without prior notice if the User falls under any of the following circumstances:
    1. Violation of any provision of these Terms.
    2. Discovery of false information in the registered details.
    3. No response from the User to communications from the Operator for a certain period.
    4. No use of the Service for a certain period since the last use.
    5. Other circumstances in which the Operator determines that the use of the Service is inappropriate.
  2. The Operator shall not be liable for any damages incurred by the User as a result of actions taken by the Operator under this Article.

Article 8 (Disclaimer of Warranties and Limitation of Liability)

  1. The Operator does not warrant, expressly or impliedly, that the Service is free of defects (including but not limited to defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors, bugs, or infringements).
  2. The Operator shall not be liable for any damages incurred by Users arising from the Service, except in cases of intentional misconduct or gross negligence by the Operator.
  3. The Operator shall not be involved in or liable for any transactions, communications, or disputes that may arise between Users and other Users or third parties in relation to the Service.

Article 9 (Changes to Service Content)

The Operator may change, add, or discontinue the content of the Service with prior notice to Users, and Users shall consent to this.

Article 10 (Amendment of Terms of Service)

  1. The Operator may amend these Terms without the individual consent of Users if:
    1. The amendment is in the general interest of Users.
    2. The amendment does not contravene the purpose of the service usage agreement and is reasonable considering the necessity of the amendment, the reasonableness of the content after amendment, and other circumstances related to the amendment.
  2. The Operator shall notify Users in advance of amendments to these Terms, the content of the amended Terms, and the effective date.

Article 11 (Handling of Personal Information)

The Operator shall handle personal information obtained through the use of the Service appropriately in accordance with the "Privacy Policy" provided by the Operator.

Article 12 (Notifications and Communications)

Notifications or communications between Users and the Operator shall be made by the method specified by the Operator. Unless Users notify the Operator of changes in the manner separately determined by the Operator, the Operator shall assume that the currently registered contact information is valid and send notifications or communications to that contact, which shall be deemed to have reached Users at the time of dispatch.

Article 13 (Prohibition of Assignment of Rights and Obligations)

Users shall not assign or pledge their position in the service usage agreement or rights or obligations under these Terms to third parties without the prior written consent of the Operator.

Article 14 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of a dispute arising in connection with the Service, the court having jurisdiction over the location of the Operator's headquarters shall have exclusive jurisdiction.

Privacy Policy

NSI LLC (hereinafter referred to as "the Operator") has established the following privacy policy (hereinafter referred to as "this Policy") regarding the handling of users' personal information in the services (hereinafter referred to as "the Service") provided on this website.

Article 1 (Personal Information)

"Personal information" refers to "personal information" as defined in the Personal Information Protection Law and means information about a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact information, or other descriptions contained in such information, as well as data related to appearance, fingerprints, voiceprints, and the insurer number of a health insurance card (personal identification information).

Article 2 (Method of Collecting Personal Information)

The Operator will ask for personal information such as email addresses when users register to use the Service.

Article 3 (Purpose of Collecting and Using Personal Information)

The purposes for which the Operator collects and uses personal information are as follows:

  1. To provide and operate the Operator's services.
  2. To respond to inquiries from users.
  3. To send emails regarding new features, updates, and other services offered by the Operator that the user is using.
  4. To communicate as necessary for maintenance, important notices, etc.
  5. To identify users who have violated the terms of use or who are attempting to use the Service for fraudulent or improper purposes, and to refuse their use.
  6. To allow users to view, change, delete their own registered information, and view their usage status.
  7. To conduct surveys and analysis for service improvement of the Service.
  8. For purposes incidental to the above purposes.

Article 4 (Change of Purpose of Use)

  1. The Operator shall change the purpose of use of personal information only when it is reasonably recognized that the new purpose is related to the original purpose.
  2. In the event of a change in the purpose of use, the Operator shall notify users of the changed purpose by the method prescribed by the Operator or publicly announce it on this website.

Article 5 (Provision of Personal Information to Third Parties)

  1. The Operator will not provide personal information to third parties without the prior consent of the user, except in the following cases or as otherwise permitted by the Personal Information Protection Law or other laws and regulations:
    1. When it is necessary to protect a person's life, body, or property, and it is difficult to obtain the person's consent.
    2. When it is particularly necessary to improve public health or promote the sound growth of children, and it is difficult to obtain the person's consent.
    3. When it is necessary to cooperate with a national or local government or its entrusted person in executing the affairs prescribed by law, and obtaining the person's consent may hinder the execution of such affairs.
    4. When the following items have been notified or announced in advance, and the Operator has notified the Personal Information Protection Commission:
      1. Including provision to third parties in the purpose of use.
      2. Items of data provided to third parties.
      3. Means or methods of provision to third parties.
      4. Stopping the provision of personal information to third parties at the request of the person.
      5. Methods for accepting requests from the person.
  2. Notwithstanding the provisions of the preceding paragraph, the following cases do not constitute third parties:
    1. When the Operator entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use.
    2. When personal information is provided as a result of business succession due to merger or other reasons.
    3. When personal information is used jointly with a specific person, and the person has been notified in advance or is in a state where the person can easily know the items of personal information used jointly, the scope of joint users, the purpose of use of the users, and the name or title of the person responsible for the management of the personal information.

Article 6 (Disclosure of Personal Information)

  1. When a person requests the disclosure of their personal information, the Operator shall disclose it to the person without delay. However, the Operator may decide not to disclose all or part of the information if disclosure falls under any of the following, and will notify the person of the decision without delay. A fee of 1,000 yen per request will be charged for the disclosure of personal information:
    1. When there is a risk of harm to the life, body, property, or other rights and interests of the person or a third party.
    2. When there is a risk of significant hindrance to the proper execution of the Operator's business.
    3. When it violates other laws and regulations.
  2. Notwithstanding the provisions of the preceding paragraph, information other than personal information, such as historical information and characteristic information, will not be disclosed in principle.

Article 7 (Correction and Deletion of Personal Information)

  1. If a user finds that the personal information held by the Operator is incorrect, the user may request the Operator to correct, add, or delete the personal information (hereinafter referred to as "Correction") according to the procedures specified by the Operator.
  2. If the Operator determines that it is necessary to respond to the request from the user based on the preceding paragraph, the Operator shall correct the personal information without delay.
  3. The Operator shall notify the user without delay when a correction is made based on the provisions of the preceding paragraph, or when a decision is made not to make a correction.

Article 8 (Suspension of Use of Personal Information)

  1. If the Operator is requested by the person to suspend or delete the use of personal information (hereinafter referred to as "Suspension of Use") on the grounds that the information is being handled beyond the scope of the purpose of use, or that it was obtained by fraudulent means, the Operator shall conduct the necessary investigation without delay.
  2. Based on the results of the investigation, if the Operator determines that it is necessary to respond to the request, the Operator shall suspend the use of the personal information without delay.
  3. The Operator shall notify the user without delay when a Suspension of Use is implemented based on the provisions of the preceding paragraph, or when a decision is made not to implement a Suspension of Use.
  4. Notwithstanding the preceding two paragraphs, if a Suspension of Use involves a significant cost or is otherwise difficult to implement, and if alternative measures can be taken to protect the rights and interests of the user, such alternative measures shall be taken.

Article 9 (Changes to Privacy Policy)

  1. The contents of this Policy may be changed without notifying users, except as otherwise provided by law or this Policy.
  2. Unless otherwise specified by the Operator, the revised Privacy Policy shall take effect from the time it is posted on this website.
